Access to the pages of the Around Wine website (“www.aroundwine.net” hereinafter referred to as “the Site”) implies the acceptance of the following Terms of Use by the user.

Acceptance.

The Site is owned by Darkage (hereinafter “publisher”). The Site has informational and e-commerce purposes. By accessing or using the services on the Site, the user accepts these Terms of Use. In case of non-acceptance, the user must refrain from using the Site.
The publisher invites Site users to periodically consult these Terms of Use and other sections of the Site such as the Privacy Policy, the Cookie Policy, and the Sales Conditions, also to check for any updates or modifications.

Industrial and Intellectual Property.

The publisher is the exclusive owner of the Site’s content, including, for example, texts, documents, images, logos, photographs, page layouts, design, know-how, and products offered for sale; some of the aforementioned content may be protected by copyright, trademarks, patents, designs, and/or other industrial and intellectual property rights recognized by Italian and international law. Use of the Site.

The e-commerce services offered by the Site are governed by the Sales Conditions.

However, users are prohibited from uploading, distributing, or otherwise disseminating through the Site illegal, obscene, defamatory, harmful to personal data rights, abusive, or otherwise unlawful and/or any material or content that may constitute a crime or incite to commit a crime, and/or violate any law or right of the publisher and/or third parties, as well as any material that may in any way damage the image and reputation of the publisher.

Warranties.

Without prejudice to what is provided for in the Sales Conditions, the materials present on the Site are provided as is, as made available, and without any warranty, tacit or express. The publisher does not provide any tacit or express warranty that the Site or its contents comply with user expectations in terms of service continuity or the absence and/or prompt correction of errors.

It is understood that some products may be presented through or in association with images or graphic reproductions whose purpose is purely illustrative.

Disclaimer.

Users access the Site independently and at their sole risk, with the understanding that the publisher declines any responsibility for any damage or harm suffered in any way by users as a result of accessing and using or downloading any material for any reason present on the Site, including viruses, malware, or other malicious electronic content. The publisher reserves the right to interrupt or suspend any service provided through the Site, at any time and without assuming any responsibility or commitment of any kind in relation to the aforementioned suspension or interruption of services provided through the Site resulting from actions or omissions of the publisher or third parties.

Applicable Law

The Site, as currently configured in terms of layout and content, is designed to be used by users located in Italy (the “Territory”), and the publisher does not provide any warranty that its content complies with the applicable legal requirements outside of said Territory.

Any dispute relating to the Site, its use, and its contents will be governed by Italian law.

Further Provisions

Subject to the content of the Sales Conditions, Privacy Policy, and Cookie Policy, these Terms of Use constitute the entire agreement between the publisher and the user of the Site regarding its use. Any other terms and conditions applied by the publisher in relation to the relationships with users of the Site will be considered as additional to these.

In the event that any provision herein is annulled or declared void or otherwise unenforceable, the remaining provisions shall remain fully valid and effective.
